In addition, for no extra charge, Fortress U Inc. will assist in providing credit repair. While the “7 Days to 740+ Credit Score Course” is one of the bundled educational courses and teaches Customers how to perform credit repair on their own, we want to make sure that our customers do not have any questions or issues and make ourselves available in the event they would like our personal assistance.
Authorization to Charge Fees for Financial Education Courses.
Subject to the Terms and Conditions of this Agreement and the description above, the purchaser of the Fortress U Education Program (the “Customer”) hereby authorizes the Company to debit the bank account or credit card listed below a total of $125.00 per month until the client cancels the account.
Terms and Conditions of Agreement:
Aside from its video and in-person financial education courses, Fortress U provides an online portal to give visitors a general understanding of the law, financial/budgetary matters, resume building, and official and legal forms for disputing debts to credit bureaus and to provide an automated software solution to individuals who choose to prepare their own documents. The portal and other included services referenced above include general information on commonly encountered legal, financial, and business issues. Fortress U and its services are not substitutes for the advice of attorneys and financial/tax professionals.
Fortress U Inc. strives to keep its legal/business documents and coaching information accurate, current, and up-to-date. However, because the law changes rapidly, Fortress U Inc. cannot guarantee that all of the information on the portal is completely current. The law is different from jurisdiction to jurisdiction and may be subject to interpretation by different courts. The law is a personal matter, and no general information like the kind Fortress U Inc. provides can fit every circumstance. Furthermore, the information contained on the portal and in instructional videos/in-person presentations is not legal/accounting advice and is not guaranteed to be correct, complete, or up to date. Therefore, if you need legal advice for your specific problem, or if your specific problem is too complex to be addressed by our program and tools, you should consult a licensed attorney in your area. Similarly, if you need specific financial advice concerning taxes, insurance, mortgages, etc. you need to obtain the advice of professionals in such matters, including accountants and other financial advisors.
In these Terms and Conditions of Agreement, the words “you” and “your” refer to each Member as described above. “We,” “us,” and “our” refer to Fortress U Inc.

Ownership.
The portal and Fortress U Inc.’s educational programs are owned and operated by Fortress U Inc.. All right, title, and interest in and to the materials provided on the portal, including but not limited to video presentations, information, documents, logos, graphics, sounds, and images (the "Materials") are owned either by Fortress U Inc. and Fortress U Inc.’s third-party authors, developers, or vendors ("Third Party Providers"). Except as otherwise expressly provided by Fortress U Inc., none of the Materials may be copied, reproduced, republished, downloaded, uploaded, posted, displayed, transmitted, or distributed in any way, and nothing on the portal shall be construed to confer any license under any of Fortress U Inc.'s intellectual property rights, whether by estoppel, implication, or otherwise. Fortress U Inc. does not sell, license, lease, or otherwise provide any of the Materials other than those specifically identified as being provided by Fortress U Inc. Any rights not expressly granted herein are reserved by Fortress U Inc. Any reference to the products and services of third-party vendors does not belong to Fortress U Inc. Fortress U Inc. has limited rights to sell such services.
Limited Permission to Download and View.
Fortress U Inc. hereby grants you permission to download, view, copy, and print the Materials on any single, stand-alone computer solely for your personal, informational, non-commercial use provided that (i) where provided, the copyright and trademark notices appearing on any Materials not be altered or removed, (ii) the Materials are not used on any other website or in a networked computer environment, and (iii) the Materials are not modified in any way, except for authorized editing of downloadable forms for personal use. This permission terminates automatically without notice if you breach any of the terms or conditions of this Agreement. On any such termination, you agree to immediately destroy any downloaded or printed Materials. Any unauthorized use of any Materials contained on the portal may violate copyright laws, trademark laws, laws of privacy and publicity, and communications regulations and statutes.

Resale of Forms Prohibited.

Important Limitation on Rights - Mandatory Arbitration Requirement –
Please read carefully: You agree that any and all controversies, disputes, demands, counts, claims, or causes of action (including the interpretation and scope of this clause, and the arbitrability of the controversy, dispute, demand, count, claim, or cause of action) between you and Fortress U Inc. shall exclusively be settled through binding and confidential arbitration. Any such arbitration shall take place in the state and county where you reside subject to the laws of the state of Nevada.
Arbitration shall be subject to the Federal Arbitration Act and not any state or provincial/ territorial arbitration law. The arbitration shall be conducted before one commercial arbitrator with substantial experience in resolving commercial contract disputes from a nationally recognized arbitration services such as JAMS pursuant to such organization’s standard rules and procedures.
In the case of arbitration and where permitted by law, you are thus agreeing to GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights EXCEPT for matters that you file in small claims court. Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury. You are entitled to a FAIR HEARING, BUT the arbitration procedures are SIMPLER AND MORE LIMITED THAN RULES APPLICABLE IN COURT. Arbitrator decisions are as enforceable as any court order and are subject to VERY LIMITED REVIEW BY A COURT.
In the case of arbitration and where permitted by law, you and Fortress U Inc. must abide by the following rules: (1) ANY CLAIMS BROUGHT BY YOU OR Fortress U Inc. MUST BE BROUGHT IN THE PARTY’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING; (2) THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS, MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING, AND MAY NOT AWARD CLASS-WIDE RELIEF; (3) in the event that you are able to demonstrate that the costs of arbitration will be prohibitive as compared to costs of litigation, Fortress U Inc. will pay as much of your filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive as compared to the cost of litigation; (4) Fortress U Inc. also reserves the right in its sole and exclusive discretion to assume responsibility for all of the costs of the arbitration; (5) the arbitrator shall honor claims of privilege and privacy recognized at law; (6) the arbitration shall be confidential, and neither you nor we may disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of enforcement of the arbitration award; (7) the arbitrator may award any individual relief or individual remedies that are permitted by applicable law; and (8) each side pays its own attorneys’ fees and expenses unless there is a statutory provision that requires the prevailing party to be paid its fees and litigation expenses, and, in such instance, the fees and costs awarded shall be determined by the applicable law.
In the event that a party fails to proceed with Arbitration, unsuccessfully challenges the Arbitrator’s award, or fails to comply with the Arbitrator’s award, the other party shall be entitled to costs of suit, including reasonable attorneys’ fees.. OPT-OUT PROCESS: You may choose to opt-out of this Arbitration Provision but only by following the process set-forth below. If you do not wish to be subject to this Arbitration Provision, then you must notify us in writing within thirty (30) calendar days of the date of this Agreement at the following address: Fortress U, Attn: Customer Service, 5016 Dodge Ridge Ave, Las Vegas NV 89139. Your written notice must include your name, address, the date of this Agreement, and a signed statement that you wish to opt out of the Arbitration Provision. If you choose to opt out, then your choice will apply only to this Agreement.
NO WARRANTY.
THE FINANCIAL EDUCATION COURSES, THE PORTAL, APPLICATIONS, AND ALL MATERIALS, DOCUMENTS OR FORMS PROVIDED ON OR THROUGH YOUR USE OF THE PORTAL AND Fortress U Inc.’S WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, Fortress U Inc. EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT CONCERNING ALL BENEFITS FOUND WITHIN THE PORTAL AND THOSE SEPARATE SERVICES OUTSIDE OF THE PORTAL. Fortress U Inc. MAKES NO WARRANTY THAT: (A) THE FINANCIAL EDUCATION COURSES, PORTAL, APPLICATIONS, THE MATERIALS, OR THE SEPARATE SERVICES WILL MEET YOUR REQUIREMENTS; (B) THE FINANCIAL EDUCATION COURSES, PORTAL, APPLICATIONS, THE MATERIALS, OR THE SEPARATE SERVICES WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE BASIS; (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE FINANCIAL EDUCATION COURSES, PORTAL, APPLICATIONS, OR ANY MATERIALS OFFERED THROUGH THE PORTAL, WEBSITE OR APPLICATIONS, WILL BE ACCURATE OR RELIABLE; OR (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE FINANCIAL EDUCATION COURSE, PORTAL, WEBSITE, APPLICATIONS, THE MATERIALS, OR THE SEPARATE SERVICES OR IN RELIANCE ON THE MATERIALS WILL MEET YOUR EXPECTATIONS.
OBTAINING ANY MATERIALS THROUGH THE USE OF THE FINANCIAL EDUCATION COURSES, PORTAL AND WEBSITE IS DONE AT YOUR OWN DISCRETION AND AT YOUR OWN RISK. Fortress U Inc. SHALL HAVE NO RESPONSIBILITY FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY CONTENT, MATERIALS, INFORMATION OR SOFTWARE.
LIMITATION OF LIABILITY AND INDEMNIFICATION.
EXCEPT AS PROHIBITED BY LAW, YOU WILL HOLD Fortress U Inc. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS HARMLESS FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGE, HOWEVER IT ARISES (INCLUDING ATTORNEYS' FEES AND ALL RELATED COSTS AND EXPENSES OF LITIGATION AND ARBITRATION, OR AT TRIAL OR ON APPEAL, IF ANY, WHETHER OR NOT LITIGATION OR ARBITRATION IS INSTITUTED), WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, OR OTHER TORTIOUS ACTION, OR ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, INCLUDING WITHOUT LIMITATION ANY CLAIM FOR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM THIS AGREEMENT AND ANY VIOLATION BY YOU OF ANY FEDERAL, STATE, OR LOCAL LAWS, STATUTES, RULES, OR REGULATIONS, EVEN IF Fortress U Inc. HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. EXCEPT AS PROHIBITED BY LAW, IF THERE IS LIABILITY FOUND ON THE PART OF Fortress U Inc., IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCTS AND/OR SERVICES, AND UNDER NO CIRCUMSTANCES WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE PRIOR LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
Compliance with Intellectual Property Laws.
When accessing Fortress U Inc. or using the Fortress U Inc. portal as part of the Fortress U Education Course, you agree to obey the law and you agree to respect the intellectual property rights of others. Your use of the Service and app.Fortressu.com is at all times governed by and subject to laws regarding copyright, trademark and other intellectual property ownership. You agree not to upload, download, display, perform, transmit or otherwise distribute any information or content in violation of any third party's copyrights, trademarks or other intellectual property or proprietary rights. You agree to abide by laws regarding copyright ownership and use of intellectual property, and you shall be solely responsible for any violations of any relevant laws and for any infringements of third party rights caused by any content you provide or transmit or that is provided or transmitted using your Fortress U Inc. user account.
Entire Agreement.
By virtue of Customer’s signature below, Customer acknowledges that he/ she has read, understands and agrees to every term, covenant and condition of this Agreement and that he/she has received a true and complete copy hereof, effective on the date below. This agreement is the only agreement between the parties and there is no other collateral agreement (oral or written) between the parties in any manner relating to the subject matter of this agreement. If any portion of this agreement is held to be invalid or unenforceable, the remaining provisions will remain in effect. The parties mutually understand and agree that a facsimile copy signature or an electronic signature on this agreement shall be deemed an original for all lawfully enforceable purposes.
Cancellation/Refund Policy.
Due to the nature of services provided and that an individual or company may immediately access the resources provided, to the extent that Customer seeks to cancel the program and access, no funds will be refunded except on a case-by-case 100% discretionary basis in which Fortress U Inc. reserves the right to determine a reasonable refund amount. Given the restrictions, it is advisable for any potential customer to perform due diligence and read reviews of Fortress U’s Financial Education programs. You may cancel anytime within five days of signing this agreement and will receive a full refund.
Fortress U Inc. offers a 100% money back guarantee for any client who does not obtain a higher credit score within 6 months as long as the client has provided the following;
a. Color copy of government issued id
b. Color copy of social security card
c. Client has not worked with another credit repair company within the last six months
d. Client provided Fortress with a new updated proof of address every month. Proof of address must be either a cell phone bill, utility bill, or bank statement.
e. Client completes all courses inside app.FortressU.com and obtains a score of 80% or higher
f. Client follows Fortress U staff’s advice including but not limited to obtaining new credit, paying existing creditors and/or paying off credit card balances.
ACKNOWLEDGMENT
As indicated by my approval of the terms and conditions below, I acknowledge that I have read, understand, and agree to the terms and conditions of the Fortress U Inc. Financial Education Program and agree to pay for the program which does not permit refunds after five business days. Fortress U Course is $125.00 a month until cancelled. Cancellation must be in writing and 7 days prior to upcoming payment.
Fortress U Program Enrollment & Credit/Debit Card Authorization
I, hereby authorize Fortress U Inc. (the “Company”) to charge credit/debit card the fees pursuant to the Fortress U Financial Education Coaching Agreement.
I agree to pay $125.00 a month to Fortress, (the “Company”) the fees pursuant to the Fortress U Financial Education. If payment fails for any reason, Fortress may block client’s access to Fortress U’s courses and online portal access.
I confirm that the accounts on my credit report that Fortress identified are inaccurate & I would like them disputed & removed from my credit report.
I authorize Fortress to bill me $125 a month until I cancel on card and I acknowledge in order to cancel my monthly subscription I must do it in writing or inside the Fortress app.
You, the buyer, may cancel this transaction at any time prior to midnight of the fifth business day after the date of this transaction. See the attached notice of cancellation form for an explanation of this right.
